Drug Charges

Drug charges can vary from the offence of possession of marijuana, which may soon disappear from Canadian criminal law, through the more serious offence of production of marijuana, to the most serious offences, which include conspiracies to traffic or to import drugs such as cocaine or heroin. Investigative techniques used will include confidential sources, the interception of communications by wiretaps, and surveillance by the police.

The defence of drug cases begins with a thorough review of the prosecution case, and will require demands for disclosure of evidence not originally disclosed.

The defence will often consist of a combination of attacks on the admissibility of critical Crown evidence, and the development of evidence to refute or blunt the key elements of the Crown's case.
