Employment law is generally used to refer to the law governing employment relations between employers and employees in a non-union environment.
An employment relationship is essentially a contractual relationship. Every employee works under a contract of employment whether that contract is written and signed or not. Even if there is no formal written contract, there is a "presumed" contract that determines key features of the employment relation:
- What work the employee will be expected to perform;
- How much the employee will be paid;
- What the working conditions will be.
