Proceeds of Crime

The law with respect to the seizure of money or other property alleged to be proceeds of crime has seen radical new developments in recent years. Law enforcement authorities are able to choose from a variety of options if they form the opinion that money or other property is derived from drug trafficking or other illegal activity. Their goal is usually to get a court to order that the property be forfeited to the Crown.

Before property is forfeited, there are numerous steps that can be taken by a property owner to recover what has been taken from him. The property owner can also obtain a court order that his living expenses be paid out of the money or other property held by the authorities.
